The petitioner seeks bail in Arwal P.S. Case No. 89 of 2018, instituted for the offence under Section(s) 394 of Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is in custody since 15.4.2018.

It is alleged in the written report that on the date of occurrence four miscreants came on two Motorcycles and snatched key of the pick-up van bearing registration No.BR-07GA-1136 by which the informant along with some other persons was going to Gaya. It is further alleged that accused persons forcibly got down the driver from the vehicle. Allegation against petitioner is that he demanded money and on non-fulfillment of

Patna High Court CR. MISC. No.21748 of 2019(4) dt.30-05-2019 2/2 the same, he shot fire on the Munshi namely, Satendra Kumar on his right knee. All the accused persons brandishing the pistol took away Rs. 3 lacs from the pocket of Satendra Kumar. Case diary has been received.

Confessional statement of injured Satendra Kumar is available in paragraph-65 of the case diary wherein he has stated that he sustained firearm injury on his leg. The injury was found on non vital part of body of the injured. Petitioner is in custody since 15.4.2018.

Keeping in view the period spent by petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Rakesh Kumar Rakesh, learned Munsif, Arwal, in connection with Arwal P.S.
