JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 406, 420, 323, 379, 504 and 120B of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that petitioner has not taken Rs. 2,50,000/- from the complainant rather he had taken Rs. 30,000/- from the complainant and that amount has already been returned to informant.

Heard learned A.P.P. as well as learned counsel for the informant. It has been submitted on behalf of the informant that Rs.2,50,000/- was given to the petitioner as he had promised

No.8781 of 2017 (2) dt.02-03-2017 2/2 to get informant engaged in the Railway and for that informant deposited some amount in petitioner's account, some amount was deposited in the account provided by the petitioner and in cash also. Now he has paid Rs.30,000/- to the informant in order to grab the whole amount.

Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.

However, petitioner is directed to surrender in the court below, i.e., learned ACJM-IX, Bhagalpur, in connection with Complaint Case no. 2097 of 2014 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.

Accordingly, this application is dismissed.
