====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Brahmpur P.S. Case No. 18 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that petitioner has clean antecedent.

It is alleged in the written report that 207.36 litres of foreign liquor has been recovered from Mahendra Logan car in which the petitioner was found sitting.

From the written report it appears that name of owner and driver of the vehicle was Alamuddin. Petitioner was found sitting in Mahendra Logan car and arrested by the police. Counsel for the petitioner submits that petitioner

Patna High Court CR. MISC. No.18808 of 2019(2) dt.29-03-2019 2/2 has no concern with the aforesaid liquor. He is neither driver nor owner of the vehicle.

Petitioner is in custody since 23.01.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ II-cumSpecial Judge (Excise), Buxar, Distt. Buxar, in connection with Brahmpur P.S. Case No. 18 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
