Mr. Sanjay Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-07-2025 Heard learned senior counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 319(2), 318(4), 316(2), 338, 103(1), 61(2) and 3(5) of the B.N.S..

3. As per prosecution case, it is alleged that all the F.I.R. named accused persons, including these petitioners, brutally assaulted son of informant by means of lathi and danda due to which he became badly injured and died during course of treatment.

4. It is submitted by learned senior counsel appearing

Patna High Court CR. MISC. No.19746 of 2025(4) dt.16-07-2025 2/2 on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Informant is not an eye witness of the occurrence. As a matter of fact, due to land dispute between the parties, this false and concocted case has been lodged. Petitioners claim clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that petitioners are named in the F.I.R. with specific accusation that they, along with other accused persons, assaulted son of informant as a result of which he became badly injured and later on, died during course of treatment. The inquest report reveals that the deceased died due to injuries caused by hard and blunt substance.

6. Considering the facts and circumstances of the case, specific and direct nature of accusation and materials available on record, the prayer for grant of anticipatory bail to the petitioners is rejected.
