The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 147, 323, 324, 379, 354, 504 of the Indian Penal Code.
It is alleged that for fixing the bamboo stick on the land of the informant protest was made, when the accused persons assaulted the informant, his brother and daughter. It is alleged against this petitioner that he has assaulted with dabia on the head of the informant. The petitioner tore the cloth of the daughter of the informant and snatched Rs. 10,000/- from the pocket of the informant.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.37074 of 2015 (2) dt.15-09-2015 petitioner that for a petty dispute the accusation has been levelled. For the occurrence of 05.05.2015 the First Information Report was registered on 13.05.2015. Though, there is counter version of the occurrence. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. It is submitted by the learned counsel for the informant that accusation of assault against the petitioner is specific.
Considering the delayed lodging of the F.I.R. , let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No. 167 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
