The petitioner prays for bail in Hawai Adda P.S. Case No. 78 of 2016 registered under diverse penal provisions of the Arms Act. The allegation is that on a search carried out of his person, one country-made pistol and two live cartridges were recovered.

It is stated that owing to the arrest effected in the present case, he was also made accused in another case, as stated in paragraph 3 of the bail petition in which he has been granted bail by the court below itself. Apart from these two cases, there is no other criminal case against the petitioner who is in custody since

Learned APP on going through the records has not disputed the said submissions.

Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri Saurab Singh, Judicial Magistrate 1st Class, Patna in Hawai Adda P.S. Case No. 78 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
