JUSTICE SHIVAJI PANDEY ORAL ORDER 09-07-2020 Heard learned counsel for the petitioner and learned counsel for the State, through virtual Court proceeding. In the present case, the petitioner is seeking bail in connection with Special Case No.10 of 2020 arising out of Kotwali P.S. Case No. 33 of 2020 registered for the offence punishable under Sections 401, 413, 414, 120 (B) of the Indian Penal Code and Section 8 (c), 21 (a), 15 of NDPS Act. The police has recovered one puriya of Ganja from the possession of the petitioner, however, it is urged that nothing has been recovered from the possession of the petitioner and he is in judicial custody since 11.01.2020. An affidavit has been filed by the mother of the petitioner ensuring that the petitioner will not indulge in such activity in future.

No.20000 of 2020(3) dt.09-07-2020 2/2 Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Patna in connection with Special Case No. 10 of 2020 arising out of Kotwali P.S. Case No. 33 of 2020 with a further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.

That apart, he would be required to appear before the Officer-in-charge of Kotwali Police Station by 7th of every month till six months. The conduct of the petitioner will be kept under watch in the aforesaid period by the officer-incharge of Kotwali Police Station and if it is found wanting in any respect, a report shall be made to the court concerned by him to initiate a proceeding for cancellation of bail for reasons of misuse of bail.
