JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 26-08-2015 This application has been filed for modification of the order dated 29.01.2015 and 29.04.2015 passed in Cr. Misc. No. 30468 of 2014 and 20095 of 2015 respectively by submitting that due to unavoidable circumstances the petitioner could not get prepared the bank draft and now the petitioner has got issued bank draft in favour of the petitioner of Rs. 2,50,000/- and Rs. 50,000/- and, as such, two weeks further time may be allowed for complying the order dated 29.01.2015 passed in Cr. Misc. No. 30468 of 2014.

Heard.

Considering the facts and circumstances of the case, two weeks further time is allowed to the petitioner to deposit two bank drafts of Rs. Rs. 2,50,000/- and Rs. 50,000/- issued in favour

Patna High Court Cr.Misc. No.39625 of 2015 (2) dt.26-08-2015 of the informant in the court below and then the petitioner shall be enlarged on provisional anticipatory bail in case of his arrest or surrender within two weeks from the date of receipt/production of a copy of this order on furnishing of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Rampur P.S. Case No. 208 of 2013, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. and if the rest amount i.e. Rs. 8,45,000/- is deposited by the petitioner in three equal monthly installments then, his provisional anticipatory bail shall be confirmed by the court below itself. However, it is made clear that no further extension of time or modification will be allowed. In the result, this modification application is allowed. (Jitendra Mohan Sharma, J) avin/- U T
