The petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No.153 of 2016 registered for offences under Sections 467, 468, 419 and 420 of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act, 1981.

Learned counsel for the petitioner seeks permission to withdraw this application.

This application is permitted to be withdrawn. In case the petitioner surrenders and prays for regular bail before the court below within a period of eight weeks from today, the court below will consider the petition for regular bail of the petitioner in view of the judgment of this Court in the case of Mahendra Prasad Singh vs. The State of Bihar reported in 2004 (3) PLJR 491.

It is made clear that this Court has not considered the merits of the case in view of the aforesaid submission of the petitioner and the court below will not be prejudiced by rejection of this application.
