JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 23-02-2015 Petitioner was put under suspension way back on 21.9.2010 under the orders of the District Returning Officer- cumDistrict Magistrate, Muzaffarpur. Thereafter a set of charges was issued upon him, a departmental proceeding conducted and enquiry report submitted holding the petitioner guilty of some of the charges. On a second show cause being issued upon the petitioner on 18.9.2014, he submitted his response on 11.10.2014. But the District Magistrate has not taken any decision as to what is required to be done on the issue so far.

Looking at the limited prayer as well as keeping in mind that the petitioner is under suspension since the year 2010, the
