The petitioner has prayed for bail in a case registered for the offence punishable under sections 498A, 302/34 of the Indian Penal Code.

As per allegation in the FIR, petitioner along with his family members has tortured in various ways to the sister of the informant due to non-fulfillment of dowry demand and ultimately in connivance with each other they killed her. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is husband of the deceased. There are two children out of the said wedlock. He has been falsely implicated in this case. There is no prior complain regarding

Patna High Court CR. MISC. No.21942 of 2023(3) dt.21-06-2023 2/2 harassment or torture against the petitioner. Over a trivial dispute with her husband, she committed suicide by hanging. Petitioner is languishing in judicial custody since 22.3.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in connection with Minapur P.S. Case No. 184 of 2021.
