2. Petitioner seeks bail who is in custody since 26.03.2024 in connection with Didarganj P.S. Case No. 121 of 2024, F.I.R. dated 25.03.2024 for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

3. According to prosecution case, over a petty dispute this petitioner killed the younger brother of the informant by means of repeated knife blows.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged as in the FIR is false and fabricated and the petitioner has not committed

5. Learned Additional Public Prosecutor on the basis of material available on record as well as case diary has vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the FIR it appears that there is direct and specific allegation against the petitioner that he has assaulted the brother of the informant by means of repeated knife blows upon chest of the deceased and during the treatment he died. It is further alleged that the allegation is also supported by the medical evidence (postmortem report).

6. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with Didarganj P.S. Case No. 121 of 2024 pending in the court of learned District & Additional Sessions Judge IV, Patna City.

7. Prayer is refused.
