Learned counsel for the Opposite party No. 2 is not present.
The petitioner apprehends his arrest in connection with Complaint Case No. 2763(C) of 2013 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. Learned counsel for the petitioner submits that there was an agreement for sale and purchase of land in which certain amounts have exchanged hands between the parties. It is further submitted that the petitioner has received a sum of Rs.51,000/- out of which Rs.31,000/- has been repaid to the complainant- opposite

Considering the aforesaid facts and circumstances of the case and also that the signature on the deed of agreement is the subject matter of verification by the court below, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna, in connection with Complaint Case No. 2763(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
