The petitioner apprehends his arrest in connection with Piro P. S. Case No. 6 of 2015 instituted under Sections 385 and 387 of the Indian Penal Code.

The allegation, in brief, is that criminal Sanjay Yadav, on call, made a demand of extortion money of Rs. 5 lacs from the informant and the said call was made from the mobile number of this petitioner.

Learned counsel for the petitioner submits that the SIM in the name of the petitioner was got fraudulently issued by some other person. However, learned A.P.P. submits that SIM is issued in the name of the petitioner which was issued after proper verification and submission of documents.

Patna High Court Cr.Misc. No.6499 of 2017 (3) dt.18-03-2017 2/2 In view of the aforesaid facts, it is not a fit case for grant of anticipatory bail to the petitioner. It is accordingly rejected.

However, petitioner, if so advised, surrenders before the learned court below and files application for regular bail, the same shall be disposed of without being prejudiced by this order. (Arun Kumar, J) Sujit/- U
