One country made loaded Katta along with live cartridges and mobile phone are said to have been recovered from possession of the petitioner when petitioner and others had assembled to make preparation for committing dacoity but submission on behalf of the petitioner is that petitioner was picked up by the police three days prior to the alleged occurrence and, subsequently, father of the petitioner filed a petition before the Additional Chief Judicial Magistrate-I, Danapur, Patna, then police implicated the petitioner in the present crime.
