JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bounsi P.S. Case No. 316 of 2017 instituted for the offence under Sections 399, 402 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act. Counsel for the petitioner submits that petitioner has not been apprehended on the spot. Five persons were apprehended on the spot as mentioned in the written report. The name of petitioner has been disclosed in the confessional statement of co-accused persons who have been apprehended on the spot. Counsel for the petitioner further submits that there is no recovery of any incriminating article from possession of the petitioner.

Petitioner is in custody since 7.5.2017.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Banka, in connection with Bounsi P.S.
