The petitioner apprehends her arrest in Bithan P.S. case No. 148 of 2017 registered under Section 302, 201, 34 of the IPC.

The father of the deceased alleged that his daughter was married with Baiju Paswan in the year 2009. The informant got information that her husband, father-in-law and mother-inlaw killed his daughter and hurriedly cremated the dead body. When the informant went to see his daughter he found that dead body of his daughter was cremated.

The learned counsel for the petitioner submits that petitioner is mother-in-law of the deceased. The marriage was solemnized in the year 2009. The petitioner is suffering from leprosy. The petitioner never demanded any dowry nor tortured

The informant later on filed petition that on wrong information he lodged the case. Taking into consideration the facts aforesaid and nature of allegation made against the petitioner and the fact that petitioner is mother-in-law of the deceased and she is suffering from leprosy, the petitioner, above named, in the event of her arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on her furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Rosera, Samastipur in connection with Bithan P.S. case No. 148 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
