2. The petitioner seeks bail in connection with Harnaut P.S. Case No. 111 of 2023 dated 18.02.2023 registered for the offence punishable under Section 394 of the I.P.C. and later on after investigation, charge sheet has been submitted for the offences punishable under Sections 394, 395, 397 and 412 of the I.P.C.

3. As per the prosecution case, 3-4 unknown miscreants are alleged to have snatched the bag of the informant containing Rs. 95,000/- and they also withdrew Rs. 8500/- from his phone pay.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.24629 of 2024(2) dt.27-03-2024 2/3 that the petitioner is innocent and has been falsely implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has surfaced in the present case on the basis of the confessional statement of the co-accused Gautam Kumar. No incriminating article has been recovered from the conscious possession of the petitioner. The petitioner has seven criminal antecedents. It is submitted that the petitioner is in custody since 28.12.2023. It is further submitted that other co-accused persons have been granted bail by a Bench of this Court vide Cr. Misc. No. 44103 of 2023 under order dated 26.07.2023, Cr. Misc. No. 44278 of 2023 under order dated 26.07.2023 and Cr. Misc. No. 43433 of 2023 under order dated 27.07.2023 annexed as Annexures P/2 series to the bail application.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody of the petitioner, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court concerned, Nalanda at Bihar Sharif, in connection with Harnaut P.S. Case No. 111 of 2023.
