JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Baruraj P.S. Case No.176 of 2019 registered under Sections 304(B), 201 and 120(B)/34 of the Indian Penal Code.

The accusation is that the informant Rajendra Mahto performed the marriage of his daughter with Mukesh Mahto, son of Ram Vilash Mahto, resident of village-Pansalwa. After marriage, the daughter of the informant went to her Sasural but the daughter of the informant was being tortured by her husband Mukesh Mahto, mother-in-law Janki Devi, father-in-law Ram Vilash Mahto and Dewar (brother-in-law) Nitesh Kumar (petitioner) for the dowry demand of cash Rs.2,00,000/- and

Patna High Court CR. MISC. No.18684 of 2020(2) dt.09-06-2020 2/2 gold chain. Lastly, on 18.08.2019, the daughter of the informant was killed by her husband and other in-laws and her dead body was concealed by them.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is Dewar (brother-in-law) of the deceased, the daughter of the informant. The petitioner used to reside separate to Mukesh Mahto, the husband of the deceased, but with an ulterior motive, he has also been falsely implicated in this case. The petitioner is in custody since 17.11.2019 and on investigation, the police has already submitted the chargesheet against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Muzaffarpur, in connection with Baruraj P.S.
