The petitioner is facing prosecution in connection with Katihar Town P.S. Case 490 of 2015 registered for offence under Sections 341, 324, 307, 504 and 506/34 of the Indian Penal Code. The allegation is that the petitioner gave knife blow which pierced the abdomen of the informant while other co-accused person caught hold the informant.
Learned counsel for the petitioner submits that on certain quarrel, the present occurrence has occurred. It is further submitted that the petitioner has no criminal antecedent and is languishing in jail custody since 28.10.2015. Learned A.P.P. opposed the prayer for bail of the petitioner and contends that some witnesses have supported the
Patna High Court Cr.Misc. No.47782 of 2016 (2) dt.10-11-2016 prosecution case according to the F.I.R.
Considering the facts and circumstances of the case, this Court declines the prayer for bail. Application is rejected. However, the petitioner shall have liberty to renew his prayer for bail after five months.
