The petitioner is in custody in connection with Sahebpur Kamla P.S. Case No. 235 of 2018, registered for the offence punishable under Sections 30 (A), 32 (3), 35 (c) & 36 of the Bihar Prohibition & Excise Amendment Act, 2016. Learned counsel for the petitioner submits that in the instant case approximately 300 liters liquor was seized. Learned counsel for the petitioner submits that petitioner was earlier made accused in certain cases but none of the case registered under provisions of Excise Act. Learned counsel for the petitioner next contended that petitioner was not apprehended by the police on spot, his name surfaced on the basis of secret

Considering the fact that petitioner has remained in custody nearly seven months, the court is inclined to grant bail to the petitioner. Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II-Cum- Special Judge Begusarai in connection with Sahebpur Kamal P.S. Case No. 235 of 2018.
