2. The petitioner has preferred this application for grant of regular bail in connection with Madhuban P.S. Case No. 199 of 2011 registered for the offences punishable u/s 363, 366(A) and 34 of the I.P.C., and he has clean antecedent.

3. As per the prosecution case, the petitioner along with other co-accused persons are alleged to have kidnapped the minor daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the co-accused, namely, Amitabh Kumar Rai, who had kidnapped the victim girl

Patna High Court CR. MISC. No.20650 of 2025(2) dt.09-05-2025 2/3 for the purpose of marriage has been enlarged on bail vide order 26.06.2012 passed in Cr. Misc. No. 11239 of 2012 by a coordinate Bench of this Court. It is next submitted that the petitioner has no concern with the alleged incident and he was not even aware of such case being lodged against him and when the petitioner came to know about the present case, he had wilfully surrendered before the Court below on 11.12.2024 and since then he is in judicial custody. It is lastly submitted that the petitioner has clean criminal antecedents.

5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions of the parties and taking into account the fact that there is nothing specific alleged against the petitioner and also considering the fact that the co-accused, namely, Amitabh Kumar Rai, has already been granted bail vide order 26.06.2012 passed in Cr. Misc. No. 11239 of 2012, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran in connection with Madhuban P.S. Case No. 199 of 2011.

7. The Court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.

8. The application stands allowed.
