The application is for grant of bail for the offence under Sections 395 and 412 of the Indian Penal Cade. It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR, neither has he been put on TIP nor anything has been recovered from the possession of the petitioner and his name appeared only on the basis of confessional statement of the co-accused. The petitioner is in custody since 29.06.2016.

Heard learned A.P.P. also, who could not controvert the

Patna High Court Cr.Misc. No.55205 of 2016 (2) dt.09-01-2017 above facts and from perusal of the impugned order, it appears itself that nothing has been recovered from the possession of the petitioner nor has he been put on TIP and during the course of investigation, on the basis of confessional statement of the co-accused, his name transpired.

Having heard both sides. In view of the facts as stated above, let petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM, Gaya in connection with Civil Lines P.S.Case No.92 of 2016 dated 8.3.2016 (G.R.No.1279 of 2016), with condition that he will co-operate in the trial of the case and make available himself on each and every date; except on genuine reasons.
