JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-05-2019 Petitioners seek bail in anticipation of their arrest in connection with Saur Bazar P.S. Case No. 556 of 2018 registered for the offences punishable under Sections 341, 323, 364, 504, 506 and 34 of the Indian Penal Code.

Allegation as per FIR is that the informant was forcibly abducted by accused persons and assaulted and brought to the village Laud in the house of one Shambhu Chaudhary and as the petitioners started searching her, she was brought to the house of the petitioners, who are father, uncle and co-villager of the informant. Submission of learned counsel for the petitioners is that there is no allegation against the petitioners of kidnapping, rather

No.20361 of 2019(3) dt.17-05-2019 2/2 allegation of kidnapping is against other accused persons, who left her to the house of the petitioners and as earlier she fled away on the order of the court she was handed over to petitioner No.1 but she is in habit of running away from the house.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Saur Bazar P.S.Case No. 556 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
