The petitioner seeks bail in Excise Case No. 912 of 2018, CIS No. 912 of 2018 (G.O.-295 of 2018), registered for the offences punishable under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016.

From a car, the Excise Officials recovered 70 litres of country made liquor in two plastic bags. The petitioner was found in the car.

Learned counsel for the petitioner has submitted that the petitioner has no connection with the car seized by the Police, from which the country made liquor was recovered. He also contends that the petitioner has no criminal history. He further submits that if he is again implicated in similar type of

Patna High Court Cr.Misc. No.62058 of 2018(2) dt.08-10-2018 2/2 offence, the Court may consider the cancellation of his bail, if allowed in the present case.

Considering the above submissions, this application is allowed.

Let the petitioner, Tuntun Pandey, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of the learned Additional District Judge-II -cum- Special Judge, Nawada in Excise Case No. 912 of 2018, CIS No. 912 of 2018 (G.O.-295 of 2018).
