JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
The basic allegation is of torture for non-fulfillment of dowry demand.
The matter was referred to the Mediation Centre. It appears that the dispute has been resolved on payment of Rs.75,0000/- and transfer of 7 decimals of land. Considering the present stand of the petitioner, let the above named petitioner be released on anticipatory bail in the
Patna High Court Cr.Misc. No.45811 of 2013 (9) dt.09-02-2015 2/2 event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria, in connection with Complaint Case No.2359C of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
The complainant will be at liberty to file a petition for cancellation of bail of the petitioner, if the petitioner fails to comply the terms of the agreement reached between the parties during mediation.
