The petitioner is accused in connection with Akbarpur P.S. Case No. 187 of 2018 registered under Section 30(a) of the Bihar Excise Act.

The accusation is of recovery of 100 pouches each containing 200 ml country made liquor kept in a bag which was thrown in the mud near the village road. The villagers arrested one person and handed over to the police saying that this person has thrown the bag in the mud near the road and apprehended person also disclosed his name as Manoj Yadav(petitioner). Learned counsel for the petitioner submits that it would appear from the F.I.R. that nothing was recovered from

Patna High Court Cr.Misc. No.62414 of 2018(2) dt.06-10-2018 2/2 the conscious possession of the petitioner, but mere on suspicion, villagers apprehended the petitioner and handed over to the police. It is further submitted that petitioner has no criminal antecedent and is in custody since 31.07.2018. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.-II-cum-Special Judge, Nawada, in connection with Akbarpur P.S. Case No. 187 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
