Mr.A.P.P ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-09-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in Angarh P.S. Case no. 20/2020 registered for the offence punishable under section 302/34 of the Indian Penal Code.

As per prosecution case, this petitioner along with other accused persons assaulted the father of the informant as a result of which he became injured and unconscious and in course of treatment, died.

It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case and post mortem report does not support the allegation. Petitioner is in custody since 25.11.2020. Charge sheet has already been framed. Learned counsel for the State opposed the prayer for

Patna High Court CR. MISC. No.30208 of 2021(3) dt.27-09-2021 2/2 bail and submitted that there is direct and specific allegation against this petitioner of assault as a result of which father of the informant died in course of treatment. Post mortem report also suggests that deceased sustained several injuries. Considering the nature of accusation and gravity of offence, the prayer for bail is rejected.
