2. In this case, the petitioner is seeking regular bail in connection with Khagaria P.S. Case No. 1088 of 2023, registered for the offences punishable under Sections 25(1A)/26(2)/35 of Arms Act.

3. As per allegation, house of co-accused Babu Ram Yadav was raided and one Sten gun and four live cartridges were recovered. Babu Ram Yadav was arrested from his house. It has been mentioned that one person became successful in fleeing away.

4. Learned counsel for the petitioner has submitted that arms and ammunition were recovered from the house of co-

Patna High Court CR. MISC. No.23478 of 2024(3) dt.04-07-2024 2/2 accused and not from the house of petitioner. He was not arrested at the spot. His name has figured only in disclosure of said Babu Ram Yadav except that there is nothing against the petitioner. He is under custody since 20.10.2023.

5. On the other hand, learned APP, Shri Shailendra Kumar has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 1088 of 2023, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) The learned court below shall verify the criminal antecedent of the petitioner.
