The petitioner seeks bail in connection with Excise Case No. 48 of 2016 registered for the offences punishable under Section 47(a) of Bihar Excise (Amendment) Act, 2016.

Allegedly, from possession of the petitioner from bag 21 pieces bottles each containing 180 m.l. of foreign liquor and 4 pouches each containing 200 m.l. of liquor were recovered and petitioner is in custody since 02.08.2016.

In the facts and circumstances stated above, considering the detention of the petitioner, he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Dehri (Rohtas), in connection with Excise Case No.

Patna High Court Cr.Misc. No.41789 of 2016 (2) dt.06-10-2016 2/2 48 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
