Petitioner already in custody in connection with Khagaria (Gangaur) P.S. Case No.508 of 2016 is an accused in a case registered under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation in brief is that the informant's husband had had gone into the field to cut grass and later on his dead body was found shot by firearm.

It is submitted that the First Information Report is against unknown and the only material in the case diary is that the petitioner had illicit relationship with one Pankaji Devi and deceased had seen that relationship and, therefore, he was eliminated. Except that there is no material against the petitioner.

Having considered the said facts and circumstances, let the petitioner, namely, Raghuni Sah be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Gangaur) P.S. Case No.508 of 2016.
