====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-06-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 354(d), 504, 506, 509(ii) of the Indian Penal Code and Section 66, 67, 67(a) of the Information Technology Act.

Petitioner is alleged to have posted photographs of daughter of the informant with obscene songs from a fake I.D in the name of informant's daughter.

Learned counsel appearing for the petitioner submits that petitioner and informant are agnates. It is next submitted that there is case and counter case between the parties as petitioner himself has lodged a case against the informant on the same date i.e. Hajipur Sadar P. S. Case No. 732 of 2022 and in

Patna High Court CR. MISC. No.20844 of 2023(2) dt.28-06-2023 2/2 retaliation, this false and concocted case has been lodged against him. Petitioner has got clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali, Hajipur in connection with Hajipur Sadar P. S. Case No. 712 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
