JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through the virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 02.03.2022 and is a person with clean antecedent and the informant alleges that on 14.02.2022, his minor daughter, aged about 17 years, did not return home and on search she could not be located, further it is alleged that the victim had a Mob. No. 6203395720, it is next alleged that on search several mobile number were recovered from her notebooks and thus alleges that holder of the recovered mobile numbers might have taken her for the purposes of marriage.

No.20652 of 2022(3) dt.06-01-2023 2/2 Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that the victim has come back and her statement recorded under Section 164 Cr.P.C., wherein she has not supported the case of the prosecution.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submission made by the learned counsel for the petitioner, the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bakhtiyarpur P.S. Case No. 86 of 2022.
