Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 35 of the Arms Act.

The petitioner and other co-accused persons were apprehended by the police and they disclosed their name as Gulsan Kumar and Sunny Kumar Yadav. On search, a loaded country-made pistol was recovered from the possession of Gulshan Kumar.

Nothing has been recovered from the conscious possession of the petitioner. The petitioner is aged about 18 years. The petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 21.02.2022. Learned A.P.P. for the State has opposed the bail petition of the petitioner by submitting that the petitioner was driving motorcycle from which illegal arms was carried by one co-accused, Gulshan Kumar.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka (Barahat) P.S. Case No. 44 of 2022.

The application stands allowed.
