Petitioner seeks bail in a case registered under sections 272, 273, 414 of the Indian Penal Code and 47(A) of the Bihar Excise (Amendment) Act.

Petitioner and one Rajesh Kumar Yadav were caught by the police while they were going on the motorcycle. Admittedly, nothing was recovered from conscious possession of the petitioner and the entire recovery has been made from two four wheelers. The impugned order does not show that the petitioner has any concern with the seized vehicles as well as liquor. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent and is languishing in jail custody since 3.9.2016, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
