The petitioners seek regular bail in connection with Excise Case No.138 of 2018 arising out of from P.R. Case No.15 dated 28.08.18, registered for offences punishable under Section 30(a) of Bihar Prohibition & Excise Act, 2016.

Allegation of recovery of 263.790 litres of liquor from the vehicle of the petitioner.

Submission of learned counsel for the petitioner is that he is neither driver nor the owner of the vehicle. He is in custody for more than two months. Petitioner is having no criminal antecedent and prosecution report has already been submitted. Heard learned A.P.P. also.

No.62076 of 2018 (2) dt.12-10-2018 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of the learned Spl. Judge, Excise Act, Muzaffarpur, in connection with Excise Case No.138 of 2018 arising out of from P.R. Case No.15, subject to condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
