Petitioners, who are in custody, seek bail in connection with Special Case No. 8229 of 2018 arising out of Didarganj P.S. Case No. 157 of 2018 registered for the offences punishable under Sections 30(a) of the Bihar Excise Amendment Act, 2016.

Allegation against petitioners are of recovery of 200 liters country made Mahua wine from the husk house of the petitioner No.1 and Petitioner No.2 and 3 who were sleeping beside the husk house.

It has been submitted on behalf of the petitioners

Patna High Court Cr.Misc. No.63741 of 2018(2) dt.29-10-2018 2/2 that they are innocent and have committed no offence. They have been falsely implicated in this case. They have no knowledge about the alleged recovery made from he hush house. They have no criminal antecedent. They are in custody since 06.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 8229 of 2018 arising out of Didarganj P.S. Case No. 157 of 2018.
