The petitioner seeks bail in Marhaura P.S. Case No. 364 of 2017, registered for the offence punishable under Sections 302 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is not named in the FIR.

Learned counsel, appearing on behalf of the petitioner, submits relying on certain orders passed by this Court, which have been brought on record by way of Annexures- 5 and 6 of the present application that the main allegation is against one Firoz Rai, who is said to have fired at the deceased. He contends that the said Firoz Rai has been granted regular bail by this Court by order dated 17.09.2018,

Patna High Court Cr.Misc. No.62112 of 2018(2) dt.08-10-2018 2/2 passed in Cr. Misc. No. 37850 of 2018. He also submits that similarly circumstanced co-accused person, namely, Jagdish Yadav has been granted regular bail by another order of this Court dated 31.07.2018, passed in Cr. Misc. No. 43229 of 2018. Considering the fact that similarly circumstanced accused persons have been granted bail, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Marhaura P.S. Case No. 364 of 2017.
