====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-10-2018 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Bikramganj P.S.Case No. 223 of 2017 registered under Sections 272 and 273 of the Indian penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no any recovery from the conscious possession of this petitioner. The seizure list is the part of the FIR from which it appears that recovery of country made liquor has been made from a pick-up van. The petitioner is in custody since 26.07.2018. In the written report, it is alleged that in total 1180 litres of liquor is said to be recovered from a pick-up van and this petitioner managed to run away from the place of occurrence.

Patna High Court Cr.Misc. No.64243 of 2018(2) dt.26-10-2018 2/2 Considering the aforesaid fact and circumstances, the prayer of bail of the petitioner is allowed. The petitioner, abovenamed, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 223 of 2017 with condition that both the bailors shall be the close relative of the petitioner.
