This is a petition for grant of anticipatory bail in a case under Section 395 of the Indian Penal Code and Section 17 of the C.L.A. Act.

Learned counsel for the petitioner submits that two cases have been instituted on 23.03.2010 bearing Belsand P.S. Case No. 30 of 2010 and Belsand P.S. Case No. 31 of 2014. He further submits that for the same occurrence two cases were instituted, one on behalf of Bharat Gas Agency and another by the police. It is submitted that the name of the petitioner did not find place in the First Information Report or even until submission of the first charge-sheet. Hence, having regard to the facts and

No.43818 of 2014 (3) dt.15-04-2015 circumstances of the case, the petitioner above named is directed to be released on anticipatory bail in the event of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Belsand P.S. Case No. 30 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr. P. C.
