The petitioners are languishing in custody for the offences punishable under Sections 341/323/324/ 307 /337 / 379/302/34 of the Indian Penal Code.
Petitioner Satyendra Singh allegedly caused injury with iron rod (Rami) to the informant and other accused including petitioner Pappu Kumar assaulted at the shoulder, arm and back.
Patna High Court CR. MISC. No.9720 of 2019(3) dt.30-04-2019 2/2 The doctor has found head injury as cause of death. Petitioner Satyendra Singh is in custody since 23.07.2018. Considering the nature of allegation and material against the petitioner Satyendra Singh, I am not inclined to enlarge the petitioner on bail for the present. Hence, the prayer for bail is refused. The trial Court is directed to expedite the trial and conclude the same preferably within nine months, failing which the petitioner would be at liberty to renew the prayer for bail before the trial judge itself.
Considering the nature of allegation against petitioner Pappu Kumar, let him be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Dawath P.S. Case No.92 of 2018, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (Birendra Kumar, J) Mkr./- U T
