JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is languishing in custody since 26.6.2016 in a complaint case filed with accusation under Sections 323, 498A,379 and 494 of the Indian Penal Code.

The basic accusation is of torture and performance of second marriage.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant and birth of a daughter and the petitioner is ready to keep the complainant as wife with full dignity and honour. Statement to that effect has been made in paragraph 9 of the petition which reads as follows:

Patna High Court Cr.Misc. No.35097 of 2016 (2) dt.17-08-2016 2/2 "That petitioner is still ready to keep his wife and daughter with love, affection and dignity but the complainant does not want to live in the company of the petitioner." Considering the nature of accusation and the period in custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Saran at Chapra in connection with Complaint Case No. 3735 of 2014.
