The petitioner is apprehending her arrest in connection with Agiaon (G) P.S. Case No. 05 of 2018 for the offence under Sections 409, 420 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that at the relevant time petitioner was a Mukhiya of the Panchayat and in the meeting in connection with the construction of the school building one Mukesh Kumar was selected as contractor except participating in that meeting petitioner has no role play in the matter of construction of Building and utilization of fund. In the instant case out of Rs. 8,10,000/- was allotted but only construction of Rs. 1,92,300/-
Patna High Court Cr.Misc. No.68409 of 2018(2) dt.17-12-2018 2/2 was done and remaining amount is alleged to have been misappropriated. Learned counsel for the petitioner submits that the construction in all respects has been subsequently completed and it is now matter of measurement and accounting and that too against those who were directly concerned with the construction of the school building.
Considering the totality of the facts situation, the Court is inclined to grant privilege of anticipatory bail to the petitioner, let the petitioner above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Court of learned Additional Chief Judicial Magistrate-VII, Bhojpur, Ara, in connection with Agiaon (G) P.S. Case No. 05 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C..
