The petitioners seek bail in Shashtri Nagar P.S. case No. 143 of 2015 under Section 420, 406 of the Indian Penal Code. The learned counsel for the petitioners submits that the petitioners are not named in the FIR. The name of petitioners figured in the case in the confessional statement of co-accused, Satyam Kumar thereafter other accused also disclosed the name of the petitioners. SIS Cash Service Pvt. Ltd. was entrusted to stack currency notes in the ATMs. Pankaj Kumar Singh and Sujit Kumar were entrusted to stack money in the ATMs but some shortage of money was found in the ATM. On such, enquiry was
Patna High Court Cr.Misc. No.49018 of 2016 (5) dt.17-03-2017 2/2 held and it transpired that Rs. 46,96,000/- less amount was stacked in the ATM. It is submitted that other accused persons have already been granted bail by different benches of this court. Photographs of the petitioners do not come in the CCTV footage. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Aditi Gupta, learned Judicial Magistrate, 1st class, Patna in Shastri Nagar P.S. Case No. 143 of 2015 subject to condition that one of the bailors shall be Government servant and another shall be closed relative of the petitioner and local residents of the State of Bihar.
