JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-02-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with P.S. Case No. 166 of 2016, registered for the offences punishable under Sections 47(a) and (e) of the Bihar Excise Amendment Act, 2016.

Allegedly, four liters country made liquor and 60 kg. solution of jaggery were recovered from the house of the petitioner and the petitioner fled away.

Submission is of false implication and that the house is joint property where several persons used to reside. The petitioner has been made victim of circumstances and as such he

Patna High Court Cr.Misc. No.7754 of 2017 (2) dt.28-02-2017 deserves sympathetic consideration to which the learned A.P.P. opposes.

In the facts and circumstances stated above, considering the allegation attributed against the petitioner, I am not inclined to grant the privilege of pre arrest bail to the petitioner. Accordingly, such prayer stands rejected. However, in case and if so advised, the petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered on its own merit without being prejudiced by this order.
