JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 14.03.2010 in a case registered for the offences punishable under Sections 392, 411 of the Indian Penal Code.

No doubt, earlier the prayer for bail of the petitioner was rejected by this court taking note of his criminal antecedent as well as allegation levelled against him and a direction was given to trial court to expedite the trial of the petitioner but the impugned order dated 10.06.2016 goes to show that up till now, charge could not be framed against the petitioner.

Therefore, considering the period of detention of the petitioner in jail custody as well as facts and circumstances of the

No.36766 of 2016 (2) dt.28-09-2016 2/2 case, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikrahna at Dhaka, East Champaran, Motihari in connection with Kundwa Chainpur P.S.
