The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 47(a)/54 of the Bihar Excise (Amendment) Act, 2016.

180 ml foreign liquor was recovered from the shop of this petitioner on 26.08.2016.

Submission of the petitioner is that on the alleged date of occurrence possession of foreign liquor was not an offence. In the circumstance, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.11123 of 2017 (2) dt.17-03-2017 2/2 each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/Successor Court in connection with C-2A256/16, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
