JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 This is an application for grant of anticipatory bail in connection with Bakhtiyarpur P.S. Case No. 40 of 2019, disclosing offences under Sections 379, 411 of the Indian Penal Code. Prosecution story is that on secret informant that the iron rod is being unloaded at the hotel of the petitioners at old Bypass road and on that information police reached there and persons started fleeing away and two persons were arrested and they disclosed the name of the petitioners and others. It further appears that the petitioners are accused in one more case.
Submission of learned counsel for the petitioners is that they have falsely been implicated in this case only because the truck was standing near the Dhaba of the petitioners. Further submission is that other co-accused person has been granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order
Patna High Court CR. MISC. No.20642 of 2019(2) dt.08-05-2019 2/2 dated 04.04.2019 passed in Cr. Misc. No. 18285 of 2019. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Barh, District Patna, in connection with Bakhtiyarpur P.S. Case No. 40 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is further subject to the condition that they have to cooperate in the investigation and appear before the police as and when required and further condition that if they again found in such type of case in future, the prosecution will be at liberty to move for cancellation of their bail bonds.
Let a copy of this order be sent to the Senior Superintendent of Police, Patna for needful.
