The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed against the order dated 18.12.2012 by which the learned Judicial Magistrate, Ist Class, Biharsharif (Nalanda) has dismissed the petition filed for discharge dated 12.01.2012 in Complaint Case No. 1038(C) of 2008.

Learned counsel for the petitioner though had taken the point of maintainability of the complaint case relating to jurisdiction before the Court concerned as his main ground for assailing the said order but after some arguments prefers to withdraw the application with liberty that he may

Patna High Court Cr.Misc. No.17584 of 2013 (4) dt.02-07-2015 2/2 raise all the points available to him including that of jurisdiction and maintainability of the complaint before the Court concerned at the appropriate stage.
