The petitioner seeks bail in a case registered under Sections 25(1-b)a/26 of the Arms Act.
Allegedly, one country made pistol and one live cartridge were recovered from the possession of the petitioner. It has been submitted on behalf of the petitioner that he is in jail custody since 18.03.2016. It is contended that so far the antecedent of the petitioner is concerned, he has been remanded in three cases, as disclosed in paragraph no. 3 of this application, after having been taken in custody. It is further contended that besides the present matter, the petitioner has been implicated in those cases on the basis of confessional statement of co-accused.
Patna High Court Cr.Misc. No.42614 of 2016 (2) dt.04-10-2016 Having regard to the facts and the circumstances of the case, the petitioner, Bablu Yadav @ Bablu Nut, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Saran, Chapra in connection with Doriganj Police Station Case No. 45/2016 with a further condition that one of the bailors of the petitioner must be his close relative or family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner.
Further, if the petitioner, after his release in this case, is again found to be involved in a criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds. Further, the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
